Draft temporary-protection academic solution in brief

For a person who actually falls within the temporary-protection branch covered by RD 889/2022 DT2, Spain already has a procedural accommodation: the person may start homologación/equivalencia using the special declaration in place of the full Article 13 package, while undertaking to provide the probative originals before the procedure is completed. This is not automatic recognition, not a permanent waiver of the missing diploma/transcript and not the same as the recognised-refugee/subsidiary-protection route. The operational solution is therefore verify qualifying status → admit the special DT2 declaration → open the file → identify which originals/evidence remain outstanding → allow later completion under DT2 → issue the ordinary substantive recognition decision once evidence is sufficient.

1. Current legal mechanism

RD 889/2022 DT2 establishes a special procedural route for beneficiaries within its specified temporary-protection regime.

The person may initiate homologación/equivalencia using the DT2 declaration instead of presenting the complete art.13 documentary package at the opening stage.

The declaration is a filing mechanism. It does not prove the qualification by itself.

2. What DT2 changes — and what it does not

DT2 changes the timing of documentary production.

3. Procedural timing

Project verification records that, until the proposed resolution stage, the ordinary named art.14 correction/warning/archiving periods are not applied in the same way under DT2.

The fee is deferred until completion of the instrucción under the special mechanism.

These are procedural accommodations, not final fee exemption or a change in the substantive academic standard.
